SUBJECT AND GENERALITIES

These Terms of Use (hereinafter, the “Terms”), together with any other special conditions that may be established, have as their object the website “SalsaTolomei” www.Salsatolomei.it (hereinafter, the “Website”), as well as the conditions of purchasing items through the same.

Use of the services of the Website, as well as the purchase of any of the items offered, presupposes acceptance by the Customer or User, without reservation of any kind, of each and every one of these Terms. Registration on the Website and use of the services implies that your data as a User will become part of SalsaTolomei’s archives, and their processing will be in accordance with the Privacy Policy, which the User expressly declares to know and accept.

SalsaTolomei provides information about the items and offers the possibility of their purchase through the Web Site. Those who wish to purchase the products must complete the relevant registration form that precedes the purchase process and follow the steps that SalsaTolomei will indicate through the Web Site.

These Terms, together with the Website’s Privacy Policy and Legal Notice are the only terms and conditions applicable while using the Website and purchasing items through it and supersede any other terms and conditions. Accordingly, the User who accesses the Web Site, registers for and makes a purchase of items through the Web Site, agrees to submit to and remains bound by the Terms, Privacy Policy, and Legal Notice as they are drafted at the time the Web Site is accessed. Anyone registering for the Web Site must be at least eighteen (18) years old.

ARTICLE INFORMATION

The photographs, graphic or iconographic representations, and videos related to SalsaTolomei items, as well as trade names, brands, or distinctive signs of any kind contained on the Web Site are intended to bring as much information as possible. However, the User should keep in mind that they are for guidance purposes and, consequently, lack exhaustive character. SalsaTolomei reserves the right to select, at any time, the products offered to Users through the Web Site. This will allow SalsaTolomei to add new products to those already on the Web Site at any time. It is to be understood that, unless otherwise provided, such new products will be governed by what is stated in the Terms in effect at that time.

Likewise, SalsaTolomei reserves the right to terminate access, at any time and without notice, to any of the products among those offered on the Web Site.

In the event that, due to circumstances of force majeure, an item is no longer available after making the purchase, SalsaTolomei will inform the User by email of the total or, in the case, partial cancellation of the order. Partial cancellation of the order does not entitle the User to cancel the entire order, without prejudice to the exercise of the right of termination that is due to the User in accordance with the provisions of these Conditions. In case of non-availability of the item requested by the customer, SalsaTolomei will propose its replacement with an item of similar price at the customer’s choice or according to its own discretion.

PURCHASING SYSTEM

In order to proceed with the purchase of the item, the User, who must be eighteen (18) years of age or older, must select the item they wish to purchase and add it to the Shopping Cart. Once the selection of the items to be purchased has been completed, the User must click on the “Place Order” button. Next, the items selected for your purchase will be shown and you will be required to select one of the available options for shipping the items to the address indicated and the method of payment for the items. Finally, the User should click on the “Complete Order” button.

The data provided by SalsaTolomei through the corresponding form are elements of identification and qualification to access and make purchases and are personal and intransferable.

FORMS OF PAYMENT

The forms of payment accepted by SalsaTolomei are:

PAYPAL/STRIPE/CARD:
The Customer will be directed to PayPal’s web page using its secure form of payment. Once the payment process is accomplished, you will be redirected back to Salsatolomei. On the PayPal page you will be able to make payment through PayPal account or by credit card. Under no circumstances will payment by counter check be accepted. PayPal may withhold an amount as a deposit or insurance when trying to make a purchase with the card on the PayPal platform (usually amounting to a few cents or 1€). This amount will be refunded by PayPal within approximately one month. Payment of this amount does not guarantee that the purchase has been made.

BANK TRANSFER IN ADVANCE

OTHER PURCHASE FEATURES

Shipments are made through SDA, DHL, FedEx courier companies.

Shipping costs in all cases include Value Added Tax (VAT), but no other taxes, fees, levies or surcharges.

Shipping means the delivery of products to the domicile or direction specified by the Customer during the process of order realization, limiting the delivery areas to those specified above.

SalsaTolomei delivers orders to the courier in a maximum of 48/72 hours. We are not responsible for possible delays in delivery caused by the courier company.

RETURNS

If the Customer has changed his mind or is not satisfied with his purchase for proven reasons), he may return it within 14 calendar days from the day he receives the items. In order to do so, SalsaTolomei will ask you to notify us in writing through an email to recalmi@Salsatolomei.it, indicating the data necessary to locate the purchase (First Name Last Name, order number, date). For our part, the moment we receive your e-mail, we will notify you by e-mail of its receipt and indicate the next steps to follow. In such a case, you must send us the items in perfect condition and still sealed, at the latest in 14 calendar days after receiving the items. In this case SalsaTolomei will refund the customer all costs of the original purchase. However, the customer will bear the direct expense of returning the items.

Once the order is processed, it cannot be cancelled.

TMC

All of our products have a Minimum Conservation Period (MCT) of 4 (four) years with the exception of flavored oils which have a MCT of 2 (two) years. In any case, the date of indicated on the package shall prevail (Best consumed by dd/mm/yyyy). Therefore, if at the time of purchase or receipt the product is older than the date indicated, SalsaTolomei will be responsible for taking it back and exchanging it for a valid one, incurring the costs associated with such an exchange or return. In order to handle the inconvenience we need to be notified by email to recalmi@Salsatolomei.it

It will be necessary to indicate: the reason for the inconvenience, the order number (essential to locate the purchase), the receipt of the same and photos of the damaged or incorrect item so that the situation can be assessed.

In order to exercise the warranty right, you will need to possess the proof of purchase or receipt.

Once this information is received SalsaTolomei will contact the Client to explain the steps to be followed. He shall inform of the lack of conformity of the item within 14 days from the time he notices the imperfection.

In the event that it is not objectively possible to replace the item with another in the same category, SalsaTolomei will refund the price of the same.

It is important for you to know that our warranty does not cover:

Negligent or violent use of the article.

Damage resulting from handling or tampering with the article.

TAXES

Prices include Value Added Tax (VAT) in all cases, but no other taxes, fees, levies or surcharges.

PRICES

Items will be sold at the indicated price, being in effect the price indicated at the time of order confirmation by the customer.

VALIDITY

SalsaTolomei reserves the right to change prices, items, offers and other terms of business without notice.

DISCLAIMER

SalsaTolomei’s failure to solicit strict compliance by User with some of User’s obligations under a contract or these Terms, or SalsaTolomei’s failure to exercise any rights or actions that may correspond to us under such contract or the Terms, shall not presume any waiver or limitation with respect to such rights or actions or relieve User from complying with such obligations. No waiver by SalsaTolomei of a concrete right or action will presuppose a waiver of any other right or action under a contract or the Terms. No waiver by SalsaTolomei of any of these Terms or any rights or actions under a contract shall be effective unless it is expressly stated to be a waiver and is formalized and communicated in writing to the User.

CHANGE OF CONDITIONS

SalsaTolomei reserves the right to review and modify these Terms at any time. The User shall be subject to the policy and Terms in effect at the time of using the webpage or making any order, exception made in the event that by law or decision of governmental bodies SalsaTolomei must implement changes retroactively in such Terms. In that case, possible changes will also affect orders placed by the User previously.

COMPLAINTS, COMMENTS, SUGGESTIONS

SalsaTolomei informs the user who holds the status of consumer under Art. 3(1)(a) of the Consumer Code that a European platform for online resolution of consumer disputes (so-called ODR platform) has been established.

The ODR platform can be found at: https://ec.europa.eu/consumers/odr/main/?event=main.home.show Through the ODR platform, the consumer user will be able to consult the list of ADR entities, find the link to the site of each of them, and initiate an online dispute resolution procedure for the dispute in which they are involved.

USE OF THE WEB

The Customer agrees to use this web page only to carry out legally valid research or orders and not to carry out any false or fraudulent orders. Otherwise we will be authorized to cancel it and inform the appropriate authorities.

The User shall not make any prohibited use of this website. By this is meant, among other things, the intentional introduction of viruses, Trojans or any technologically harmful material.

We will not be responsible for any damage or loss that your computer may suffer as a result of the above actions, or from using this web page or downloading content from it or to which it redirects.

SalsaTolomei is not responsible for delays in the delivery of orders and the inability to fulfill them if the cause is attributable to an act of God and therefore beyond our control. Among other causes, we consider force majeure to exist in the following cases, but without limitation: accidents; strikes; riots, threats, or terrorist attacks; fire or explosion; weather causes or natural disasters such as blizzard, flood, earthquake, shipwreck, epidemic; and problems beyond our control in means of transportation or telecommunication systems. To the extent possible, once the cause of inability or delay has ended, SalsaTolomei will make every effort to resume its business activities and be able to meet its obligations and shipments.

APPLICABLE LAW AND JURISDICTION

These Conditions shall be governed by and construed on the basis of Italian law. In the event of any kind of disagreement or complaint between the parties regarding compliance with or content of these Conditions, the parties agree to submit the resolution of the case to the competent Judges and Courts of the City of Padua.
